Payment Policy
A deposit equal to 50% of the total session fee is required to reserve the appointment date and time. No appointment will be considered booked until the deposit has been received by THE PHOTOGRAPHER (Dalena Sorrell).
The remaining balance is due prior to the delivery of the completed gallery and must be paid in full before final image downloads are released to THE CLIENT. A final invoice will be sent as soon as the edited images are completed.
Any additional services, add-ons, or package upgrades requested by THE CLIENT may incur additional charges. Any such charges must be paid in full prior to gallery delivery.
Cancellation Policy
If THE CLIENT cancels an appointment more than 24 hours before the scheduled appointment time, the deposit will be refunded within 24 hours of cancellation. Refund timing does not include any processing delays by THE CLIENT'S financial institution or payment provider.
If THE CLIENT cancels an appointment less than 24 hours before the scheduled appointment time, the deposit shall be forfeited and will not be refunded.
THE PHOTOGRAPHER reserves the right to reschedule appointments due to weather, illness, emergency, unsafe conditions, or other circumstances that would prevent THE PHOTOGRAPHER from providing services safely and effectively.
Package Changes and Add-Ons
THE CLIENT acknowledges that the package selected at the time of booking is the package that will be provided during the appointment.
Requests for package changes, upgrades, additional services, or add-ons must be communicated to THE PHOTOGRAPHER at least 24 hours prior to the scheduled appointment time. Approval of such requests is subject to availability and may require additional fees.
THE PHOTOGRAPHER is under no obligation to accommodate changes requested within 24 hours of the scheduled appointment.
Image Delivery and Usage Rights
Upon full payment of all fees due, THE CLIENT shall receive a non-exclusive license to download, print, share, and otherwise use the delivered images for personal or business purposes consistent with the intended purpose of the session.
THE PHOTOGRAPHER retains full copyright ownership of all images created during the appointment.THE PHOTOGRAPHER reserves the right to use any delivered images for portfolio display, website content, social media content, advertising, promotional materials, competitions, publications, educational purposes, and other business-related uses unless otherwise agreed to in writing.
Copyright ownership does not transfer to THE CLIENT.
Model Release
THE CLIENT grants THE PHOTOGRAPHER (Dalena Sorrell), along with Heart & Home: NETN to SWVA Photography, the irrevocable and unrestricted right to use, reproduce, publish, display, distribute, and create derivative works from any photographs, video, or other media created during the appointment for portfolio display, website content, social media content, advertising, marketing materials, promotional campaigns, publications, educational purposes, competitions, and other lawful business purposes.
THE CLIENT further represents that all individuals photographed during the appointment have consented to being photographed and that THE CLIENT has the authority to grant such permission on behalf of any minor children participating in the session.
THE CLIENT waives any right to inspect or approve the finished images or the specific use of such images and releases THE PHOTOGRAPHER from any claims arising from the lawful use of the images as described herein.
Requests for image privacy or restrictions on promotional use must be submitted to THE PHOTOGRAPHER in writing prior to the appointment and must be agreed to in writing by both parties.
RAW and Unedited Images
THE CLIENT acknowledges that THE PHOTOGRAPHER maintains full creative control over image selection and editing.
RAW files, unedited images, proofs, and unfinished images will not be provided under any circumstances.
Additional Image Requests
If THE CLIENT wishes to request images that were not included in the delivered gallery, such requests must be submitted within 48 hours of gallery delivery.
At THE PHOTOGRAPHER'S sole discretion, up to five (5) additional images may be edited and added to the gallery at no additional charge.
THE PHOTOGRAPHER is not obligated to fulfill any such request and reserves the right to determine which images, if any, are suitable for final delivery.
Location Permissions
THE CLIENT is solely responsible for obtaining any permissions, permits, approvals, reservations, or access rights necessary for photography at the location selected by THE CLIENT.
THE CLIENT warrants that THE PHOTOGRAPHER has legal permission to be present at the chosen location for the duration of the appointment.
THE PHOTOGRAPHER shall not be held responsible for any disputes, fees, fines, penalties, trespassing claims, or other issues arising between THE CLIENT and any third party regarding location access or authorization.
Client Satisfaction
THE PHOTOGRAPHER is committed to providing high-quality photography services, and reasonable efforts will be made to address concerns regarding delivered images.
If THE CLIENT identifies concerns that cannot be reasonably corrected through additional editing or, when appropriate, a reshoot, THE PHOTOGRAPHER may elect to provide a partial or full refund at THE PHOTOGRAPHER'S sole discretion.
No refunds shall be guaranteed, and all refund determinations shall be made on a case-by-case basis.
Policy Modifications
THE PHOTOGRAPHER reserves the right to modify, waive, or make exceptions to any policy described herein when deemed appropriate.
Any such modifications or exceptions will be communicated to THE CLIENT in writing and will apply only to the specific appointment or circumstance for which they are granted.
THE PHOTOGRAPHER reserves the right to reject any booking request at any time, for any reason.
